[DOL] Review of Part 9 of the Employment Relations Act 2000: Personal Grievances

Dealing with employment relationship problems

Do you have experience of the personal grievance process? How do you deal with employment relationship problems in the workplace? DOL would like to know.

The Government has asked the Department to review the personal grievance system established under the Employment Relations Act 2000. The review will focus on the system for handling personal grievances, and potential improvements.

As part of the review DOL are seeking submissions from the public and looking for people to interview who have experienced personal grievances.

If you have positive or negative views about any aspect of the personal grievance system, even if you have not experienced the system yourself, please tell DOL about them. You can make a submission by reading the discussion document and following the process outlined in the DOL consultation pages.

As part of the review DOL would also like to interview you, if you are:

·  an employee who considered taking a personal grievance but did not proceed, or

·  an employee who took a personal grievance as far as mediation, or

·  an employer, particularly in a small business, who settled a personal grievance outside of the formal system and/or went to mediation.

Email DOL with your name and contact details and DOL will call you to arrange an interview. Please note that DOL may not be able to interview everyone who expresses an interest. DOL aim to have a mixture of employees and employers from a range of industries and different sized businesses. If DOL are not able to interview you, DOL will contact you by the 22 March 2010 and ask if you could provide DOL with written feedback.

You can find out about the review, read the discussion paper, and see how to make a submission, on DOL’s consultation pages.

Submissions close on 31 March 2010.
