What happens to Sick leave when ownership is changed

Q: Could you please help me with this. When there is a change of ownership does the Sick leave roll over from the previous owner? All annual leave and Alternate leave were paid out by the previous owner. The company has more than 20 staff and they have signed a new contract which includes probationary period of 90 days.

A: If employees are under a new business entity and are provided a new employment agreement then any sick leave balance with the previous employer is not transferable.  The employee will need to qualify for entitlement with their new employer.
