Timing with returning from Parental leave

Q: Please help me understand, The Employee has returned this week from PL, after a short time on PL i.e.  8 months

The employee is taking some Annual leave to fill in gaps of working part-time hours: The Current / Entitled has been used, paid at an average rate

Then some of the accrued leave has been taken, paid at an Ordinary rate

Putting term value in negative

Does this mean that on 18 July 2024, any accrued leave becoming entitled will be paid as AWE rate being –  ie entitled 12 months after returning from PL

But meanwhile, its paid at full rate as accrued leave?


A: If the employee takes annual leave in advance, then that is not at the ord rate it is the greater of AWE and OWP under (Section 22).

Any entitlement earned while on parental is paid at AWE; any entitlement earned prior to going on parental is calculated at the greater of AWE and OWP.
