Q: An employee works 2 hours on a Public Holiday and gets paid 2 hours at time and a half plus an Alternate day in lieu.
They are normally rostered to work 8 hours on that day – do the remaining 6 hours still get paid or are they unpaid (as the employee has received the paid Alt day in lieu and T1/2 for hrs worked)?
A: The first question to ask is: Why did they only work 2 hours when they usually work 8?
The employment agreement would provide the hours to be paid, unless agreed prior.
- So, if the employee believes they would be working the 8 hours on the PH and nothing was agreed otherwise, and then the manager told them to go home after 2 hours they would get 8 hours at 1.5 and the alt day.
If it was agreed to leave early prior, then the 2 hours at 1.5 and the alt day.
