Staff returning from parental leave became entitled to annual leave during their leave and will be entitled again in the next 12 months

Q: Could you please let me know if my understanding is correct that these annual leave entitlements (on 20/6/24 and also on 20/6/25) are paid at AWE?

  • Staff went on parental leave (30/5/24 – 17/11/24).

  • Became entitled to annual leave on 20/6/24.

  • Returned from parental leave on 18/11/24.

  • In the next 12 months (18/11/24 – 17/11/25) after her return, she will become entitled to annual leave again on 20/6/25.


A: Yes, parental leave is counted as continuous employment, so the annual holiday entitlement remains on the same date.

If leave is taken that was earned during parental leave, it can only be paid at AWE, not the greater of AWE and OWP.
