Sick on a Public Holiday

Q: An employee, who was not asked to work on 6/2/24, was paid as PH not worked, has said they were sick. Do we go ahead and ignore the sick day and pay as PH not worked or can the PH be observed on another day and we pay as sick leave for 6/2/24?

Would they have a case to pay them as casuals? If so how would they work out if they are paying at least minimum wage in this scenario?

The option of making them contractors does not work as they are older women who would not be interested in managing their own taxes


A: It is PH taken as SL cannot be taken on a PH, it cannot be transferred to another day.  You can always do better than the act but if you do it for this employee may open the door for everyone else.
