Q: I wanted to ask, if someone has taken sick leave in advance, and this person leaves can this be a deduction in the termination pay the same as annual leave taken? Or does this not come into termination pay and the company has to try and recoup the money back in other ways.
A: No SL in advance does not have the same ability to be deducted from a final pay as annual leave in advance has. So the Wages Protection Act applies and the employee can withdraw their consent for this to be done.
