Q: When an employee is being paid by ACC and topping up to 100% with sick leave what happens on a Public Holiday, should be pay them?
A: You cannot be on SL on a PH.
If on ACC then it would not be an otherwise working day for the employee but that depends on how long they have been on ACC, for example:
Using a Monday PH as an example:
- Did the work the previous Monday
- Would they be working on the Monday PH
- Would they be working the Monday after
If no to all of the above they don’t get the PH, if less than 5 days of ACC then it would be a Yes
