Public Holiday when away

Q: We have an employee who hasn’t been working since mid September. ACC have not yet accepted the claim but it is in dispute. Do we pay him for public holidays while he isn’t working.

A: So what is the employee presently taking?  SL, unpaid SL, Unpaid leave, annual leave

Q: As it hasn’t been decided if it was an accident or illness, we have put it though as unpaid leave.  I believe they were looking at the possibility of a sickness benefit until the dispute with ACC is finalised so he has something to live on.
What’s the difference between unpaid SL and unpaid leave?

A: Unpaid sick is counted as continuous employment, unpaid leave only the first week is and after the first week it is a matter of agreement that is counted as continuous employment or a break in service.  What was agreed?

Q: It will be continuous employment.

A: If the employee is on a period of unpaid leave and was not working before the PH and won’t work after or work on the day then they won’t get the PH.
