Public Holiday Payment for Exiting Employee?

Q: I just found out that today is (unexpectedly) the last day for one of our NZ 24/7 continuous shift workers.

The site’s roster is such that the employee works 4 x 12hr days and then has 4 x 12hr days off and repeats that over an eight week cycle.

Today is the first day of a 4 day break for that employee, therefore the Matariki Public Holiday falls on his last non-rostered day.

His Annual Leave entitlement as at today – his last day – is 14.9988 hours.

Does he get paid for the Matariki Public Holiday as part of his final pay or not?

My confusion comes from whether to include the non-rostered days when calculating whether the Public Holiday falls within the hours of his Annual Leave entitlement.

He has enough of an Annual Leave entitlement to be paid for the Public Holiday if I were to only include his rostered days but I’m not sure which way is correct – can you advise, please?

A: If the last day is today and Friday is part of their days off the 14.99 hours gets extended from their next period of work Saturday, so they wont get the PH as that was not a work day in their current roster.

Just because they are terminating does not mean the days of work change.
