Public holiday on termination

Q: We have employee being made redundant, they will be told on 31 March and then given   1 months’ notice, so will end on  30 April

1, is termination date 31 March or 30 April

Does this depend if employee works out the notice period or not..

  1.  This employee has heaps of entitled leave , will they get the public holidays on termination  for Easter/Anzac?

Is this based on employees last day in office or termination date ?

A: If they work the notice then the 30th April is their termination day or if you are paying in lieu of notice then the 31 March is their final day.

If the final day is the March or April date annual holiday entitlement is extended from that point and if there are any PH during that time they will get them as well.

Q: What if  employees decides to leave halfway during working out notice period , does final day change to last day at work ?

A: If it is agreed they will terminate early and the rest of the notice period will be paid out yes the final day at work becomes the termination date.  If they just walk out and do not complete their notice there may be a clause in the employment agreement that you can recover the notice period not worked from the final pay (the day they did not turn up) but seek advice before doing this.
