Parental leave question

Q: We have an employee who plans to start parental leave from 28th January.

She’s on Annual leave from 20th December to 27th January.

Her baby has arrived early on 3rd January.

Do we have to start her parental leave from 3rd January?

Or can we leave it as is and pay her annual leave until 27th Jan and then start her on parental leave from 28th January?


A: In the past annual leave would stop and parental would start if the baby arrived early but that was changed a couple of years ago so now the employee finishes their annual leave but it means extended leave will be shorter if she is taking 52 weeks because the baby will turn 1 before the end of the 52 weeks.
