Q: An employee has just completed 9 months continuous service. They are going on Parental leave in January 2025 at which time will have completed 11 months continuous service. Their Manager would like to approve 12 months Parental Leave time off, even though they are only legally eligible for 6 months Parental Leave.
Is it legally OK to allow them more that the 6 months? Is it 6 months recorded as parental leave and 6 months unpaid leave, or can the whole 12 months be recorded as Parental Leave.
A: This is the correct application by law and by agreement – Is it 6 months recorded as parental leave and 6 months unpaid leave.
