New Starter – Public Holiday

Q: I have a new starter contracted to start Monday 24th October and my company is querying whether or not this person is eligible to be paid for the Public Holiday. (i believe this was an oversight on their part for the start date.)

I would believe that as this employee is on a permanent contract, and as the official start date is Monday 24th October, that yes, they are entitled to be paid for not working the public holiday, as but for the fact it is a public holiday, it would be their first day.

I cant find much information to determine this, so thought i would ask if i am correct in my assumption.

A: If the employees start date is agreed to commence on the 24 October then yes the PH applies to the employee.
