If you apply the sick leave entitlement test neither meet the test as they’ve been away most or all of the 6 months before the sick leave anniversary date.
However as they’re permanent employees, and their time away has been agreed as continuous service, would they still be entitled to their annual sick leave entitlement or not.
A: If unpaid leave has been agreed to be counted as continuous employment, then SL will just keep rolling over on the normal ANN date.
