Employee off work for Non Work related injury

Q: An employee has been off work for a non-work-related injury for 3 months. The employee is about to return.

Can the employee’s anniversary date for entitlement to annual holidays be extended as in an unpaid leave scenario?


A: No as time off on ACC is counted as continuous employment under the Holidays Act, the employee entitlement date cannot be moved (Section 16).
