Clarification of Holidays Act S22(3)

Q: Can you please clarify the part weeks of this clause for me? if someone has an unpaid day off here and there is that considered 0.1 or 0.3 of a week, or if they had up to 7 days is that then considered a 1.2 weeks (for someone who works 5 days/week)?


A: You would need to look at the employment agreement to see if the week, days in the week, and hours are defined so that a part-day can be defined.  If not, you may need to discuss with the employee to seek an agreement and then apply on what is a day and part day.
