Q: Can i please clarify. If an employee wishes to cashup leave, i see legislation states that it is 1 week per anniversary year. No problem
I have read on sites, ie employment.govt.nz that you can cashup 2 weeks if the employee gets ie 5+ weeks AL per year. Is this correct, as there is nothing written in legislation (that i saw, or understood) that allows this.
A: Yes, that is one week can be cash up (if the employer agrees) in the current entitlement year. You cannot do this for past entitlement years.
If the employer provides additional annual leave, like a 5th week that is nothing to do with the Holidays Act and it is a matter of agreement.
