Bereavement Leave/ Sick Leave while on Annual leave

Q: Can you please clarify for me around bereavement and sick leave entitelement to use WHEN ON annual leave.  So if someone has a death in the family WHILE they are on holiday, are they entitled to have their annual leave changed to sick leave?  I understand this is done if bereaved or sick PRIOR to going on annual holidays, but not sure if minimum requirements if already on holiday.

A: If on annual and the employee becomes sick the employer may allow the annual to be credited back and the time to be taken as SL, if the employee suffers a bereavement the employer must credit back annual.

Never heard of a bereavement situation being taken as SL.  One bereavement leave fits the situation better and two the employee is not entitled to get SL while on annual leave unless the employer agrees.

Q: The example around a death while on leave was just an example of the bereavement leave situation, not intended to be taken as sick leave when bereaved.

So if on leave and then bereaved, it MUST be credited back, if sick then it MAY be credited back if employer agrees.   Is it correct that if the employee gets sick prior to going on annual leave and cant take their annual, that it MUST be changed to sick leave?

A: While on annual if an employee had a bereavement or family violence leave both leaves types must have annual credited back and it now becomes the relevant leave type.
