Bereavement Leave

Q: We have a staff member who is claiming 3 days bereavement leave for her ex-husband – under the Holidays Act and the entitlement to bereavement leave of 3 days I wouldn’t think she would be entitled to 3 days?

A: The act states spouse or partner.

69Bereavement leave
(1)
An employee may take bereavement leave in accordance with sections 63 and 70 if the employee suffers a bereavement.
(2)
An employee suffers a bereavement—
(a)
on the death of the employee’s—
(i)
spouse or partner:

You will need to decide if the business is willing to cover ex-partner.  You could offer the 1 day instead.

But do consider if there are kids involved then this could be a reason, they need the three days.
