Annual leave before Extended unpaid Parental leave

Q: We have employee that is wanting to take 2 weeks annual leave after 6 months carers leave , so would be before taking extended unpaid leave

I spoked to MBIE they said we can do this , as long as 1 type of leave is being at once , but just wondering are their issues around breaking the cycle of carers and extended unpaid ?


A: The annual leave taken after carers leave will mean it will reduce the period of extended leave that can be taken by the employee (when the baby turns one or 52 weeks of parental whatever happens first is when parental stops). 

Will they earn entitlement while on carers leave, and will the annual leave used be from that entitlement (if yes then only AWE can be used so a reduced AL rate).  If they are using AL entitlement earned prior to parental then the greater of AWE and OWP so OWP will be higher as AWE has a period of carers leave (no earnings).
