Annual Leave after Parental Leave

Q: Can you please confirm for me – employees that don’t use up all their annual leave prior to going on parental leave, they then become entitled to 4 weeks while on leave on top of their balance. When they return and take annual leave, is the leave they already earnt safe, and paid out at the higher of the two calcs (which, will likely be their OWP) and is it just the 4 weeks they earnt whilst on leave that is subject to the AWP only rule?


A: The best way to sort this is to code the entitlement earned while on parental leave, to be separate from the minimum entitlement earned before.

  • Annual holiday entitlement earned before parental use the greater of AWE and OWP

Any annual holiday entitlement earned while on parental can only use AWE
