Q: One of our drivers had a stroke whilst driving the truck. He was admitted to hospital and will be off work for weeks.I haven’t seen a medical certificate and have not paid him ACC First Week Payments. However his family is insisting it is an ACC accident. Can you please give me your advice on this?
A: Was the person exerting their self at the time? Or just sitting in the cab when it happened. How is it an accident?
The ACC act states to be an injury covered by ACC (stroke) it must meet the criteria below:

Work-related personal injury includes a cardiovascular or cerebrovascular episode suffered by a person, if the episode is caused by physical effort or physical strain, in performing his or her employment, that is abnormal in application or excessive in intensity for the person.
You need to ask more questions without giving away the above to see if they state the stroke came about after heavy lifting etc.
